The incident was said to have been a deliberate stamp on Alvaro Arbeloa during the Rams 6-0 defeat at Anfield last Saturday.
Fagan will go before the FA disciplinary board tomorrow, Thursday 6th September. If found guilty he will miss three games through suspension.
